The Customer is required to carefully read these General Terms and Conditions of Sale before submitting a purchase order. Placing an order implies full knowledge and express acceptance of both these terms and the conditions indicated in the Order Form. Once the online purchase process is completed, the Customer must print and keep these General Terms and Conditions of Sale and the related order form, which have already been viewed and accepted.

1. OBJECT

1.1 These General Terms and Conditions of Sale govern the online sale of products through the e-commerce service on the Mundi Wunderkammer website by Diletta De Santis.

Given the large number of products available, their main characteristics and prices (including any additional costs) are clearly indicated directly on the website.

1.2 The products sold on the website can only be purchased and delivered in the countries specified in the Order Form.

Any orders for shipments outside of these countries will be automatically rejected during order processing.

2.2 These General Terms and Conditions of Sale regulate the offering, submission, and acceptance of purchase orders for products on the Mundi Wunderkammer website. They do not govern the provision of services or the sale of products by third parties that may be present on Mundi Wunderkammer’s website through links, banners, or other hypertext connections.

Before placing orders and purchasing products and services from third parties, we recommend checking their terms and conditions of sale, as the Seller is not responsible for services provided by entities other than the Seller.

2.3 Products are sold to the Customer identified by the data entered when filling out and submitting the electronic order form, with the simultaneous acceptance of these General Terms and Conditions of Sale.

2.4 The offers of products on the Mundi Wunderkammer website are intended for adult customers.
If you are under 18 years old, you must obtain the consent of a parent or legal guardian before making a purchase on the Mundi Wunderkammer website.

2.6 By accepting these Terms of Sale, you also release the Seller from any liability for issuing incorrect tax documents due to errors in the data provided by you when placing an order online, as you are solely responsible for their accurate entry.

3. ONLINE SALES THROUGH E-COMMERCE SERVICE

3.1 An online sales contract is a remote agreement concerning the sale of movable goods (hereinafter referred to as "Products") between you, as the Customer, and the Mundi Wunderkammer website, as the Seller. This contract is executed through an e-commerce service organized by the Seller using Internet-based communication technology.

3.2 Although the Mundi Wunderkammer website consistently implements measures to ensure that the photographs displayed on the website accurately represent the original products, including using all possible technological solutions to minimize inaccuracies, some variations may still occur due to the technical characteristics and resolution settings of the computer you are using.

Consequently, the Seller shall not be held responsible for any discrepancies in the graphical representation of products displayed on the website due to these technical reasons, as such representations are intended solely for illustrative purposes.

3.3 Before completing the contract, you must read the General Terms and Conditions of Sale, including information on the right of withdrawal and personal data processing.

3.4 The contract is concluded when the Seller receives your Order Form via the Internet, after verifying the correctness of your order details.

3.5 The available languages for entering into a contract with the Seller are Italian and English, and the applicable law is Italian law.

3.6 Once the contract is concluded, the Seller will process your Order for fulfillment.

4. ORDER PROCESSING

4.1 By submitting an Order via the Internet, you unconditionally accept and commit to complying with these General Terms and Conditions of Sale in your relationship with the Seller.

4.2 Once the contract is concluded, the Seller will send you an Order Confirmation via email.

4.3 Before sending the Order Confirmation, the Seller reserves the right to request additional information via email or phone regarding the order submitted through the Internet.

4.4 The Seller may refuse to process purchase orders that do not provide sufficient guarantees of solvency, are incomplete or incorrect, or in case of product unavailability. In such cases, we will inform you via email that the contract has not been concluded and that the Seller has not processed your Order, specifying the reasons. In this case, the amount previously reserved on the Customer’s payment method will be released.

4.5 If the products displayed on the website are no longer available or on sale after the order has been submitted, the Seller will inform you promptly and, in any case, within thirty (30) working days from the day after you submitted your order. In such a case, the amount previously reserved on the Customer’s payment method will be released.

4.6 The Seller commits to shipping the products ordered by the Customer within a maximum of 30 days from the contract conclusion date unless otherwise agreed between the parties.

4.7 Mundi Wunderkammer reserves the right to refuse orders from customers involved in legal disputes related to a previous order. This also applies in cases where Mundi Wunderkammer considers the customer unfit, including, but not limited to, cases of prior violations of contract conditions for online purchases on the website or any other legitimate reasons, particularly if the customer has been involved in fraudulent activities of any kind.

5. SALE PRICES

5.1 Unless otherwise stated in writing, all Product prices and shipping and delivery costs indicated on the website and in the Order are inclusive of VAT and expressed in Euros. The validity of the prices indicated is always and only that displayed on the website at the time the Order is submitted via the Internet. Product and shipping costs may change without prior notice. Therefore, be sure to check the final sale price before submitting the Order.

5.2 All Products are shipped directly from Italy. The Product prices and shipping and delivery costs indicated on the website and in the Order do not include any customs duties or related taxes, which cannot be calculated in advance, in the case of shipments to non-EU countries or countries where import duties are applicable. Any additional costs of this nature will be clearly mentioned at the order submission and review stage, although the exact amount of such costs will be communicated by the Carrier to the Customer upon delivery.

5.3 These costs are, therefore, the Customer’s responsibility and must be paid directly upon delivery, following the instructions specified in the Order Confirmation.

6. Payment Methods

To pay for the price of the Products and the related shipping and delivery costs, you may follow one of the methods indicated in the order form on the website https://www.mundiwunderkammer.com/, which are summarized below.

6.1 Credit and Prepaid Cards

  • 6.1.1 For online orders on our website, we accept both credit card and prepaid card payments (e.g., PostePay) without any additional charges on the product and shipping costs. You must be the holder of a valid credit card at the time of ordering the Products online, and the name on the credit card must match the billing information provided. If these conditions are not met, the order cannot be processed.

  • 6.1.2 If, upon receiving your order, you wish to exercise your Right of Withdrawal for any reason after having made the payment, the Seller will instruct the bank to refund the amount directly to your credit card.

6.2 PayPal

  • 6.2.1 If you have a PayPal account, Mundi Wunderkammer allows you to make payments using your registered email and password on www.paypal.com.

6.4 Bank Transfer

  • 6.4.1 You can pay for your order quickly and securely using your online banking. The order will be considered valid once the indicated amount has been credited to our bank account. Please contact us via email to request our bank details and authorization to proceed with the purchase through this method.

6.5 Security of Payment Information

At no time during the purchase process does Mundi Wunderkammer have access to your credit card information (e.g., card number or expiration date), as these are transmitted via a secure, encrypted connection directly to the payment service provider (bank or PayPal). No Seller database will store such data.

6.6 Liability

Under no circumstances can the Seller be held responsible for any fraudulent or improper use of credit and prepaid cards by third parties.

7. Shipping and Delivery of Products

7.1 Each shipment includes:

  • The ordered product(s);

  • The relevant shipping document/accompanying invoice;

  • Any accompanying documentation required based on the destination country;

  • Any informational and marketing materials.

7.2 The delivery of Products purchased through the Seller’s website may be carried out using different methods.

7.3 Home Delivery

  • 7.3.1 The purchased products will be delivered by the courier selected by the Seller to the shipping address provided by the Customer in the Order.

  • 7.3.2 Upon receipt of the package at your home, we ask you to check the integrity of the package at the time of delivery by the courier. Any anomalies must be reported and noted by the courier immediately.

8. Right of Withdrawal

  • 8.1 If the Customer entering into the contract is a Consumer (defined as any natural person acting on the site for purposes unrelated to any business or professional activity they may carry out), they have the right to withdraw from the contract with the Seller without penalty and without specifying the reason, by notifying the Seller within fourteen (14) days from the day the Customer or a third party designated by the Customer, other than the Carrier, takes physical possession of the goods. The deadline is considered met if the Customer returns the goods before the 14-day period expires. Please note that, according to current regulations, the right of withdrawal is excluded and cannot be exercised if the purchased products have been customized at your explicit request when placing the Order.

  • 8.2 To exercise the right of withdrawal, you have the following options:

    • 8.2.1 If you are a registered user, you must log in using your username and password and access the My Account section of the website. In the My Orders section, you will find a list of your orders, each with a link to activate the return process. By accessing the Online Return Form within fourteen (14) days from the receipt of the Products, you can notify us of your decision to withdraw from the contract and specify which Products will be returned.

8.2.2 If you placed your order without registering on the website https://www.mundiwunderkammer.com/, go to the Customer Service section and access Order Status, where you will need to enter the email used during the order and the postal code of your address. You will then be redirected to the My Orders section, where you will find the link to return the products.

8.2.3 Alternatively, you may also submit any other explicit declaration of your intention to exercise the right of withdrawal.

8.3 Upon completing the Online Return Form, you will receive all the necessary information regarding the return of the Products.

8.4 The right of withdrawal is subject to the following conditions:

  • Returned Products must be returned in their entirety and not in parts or components, even in the case of kits;

  • Returned Products must not have been used, washed, or damaged;

  • Returned Products must be returned in their original packaging;

  • Returned Products must be sent to the Seller in a single shipment. The Seller reserves the right not to accept Products from the same Order that are returned and shipped at different times;

  • Returned Products must be handed over to the courier within fourteen (14) days from the date you received the products.

8.5 If the right of withdrawal is exercised in accordance with the above conditions (paragraph 8.4), the Seller is required to refund the amounts paid by the customer within no more than 14 days from the day the Seller was informed of your decision to exercise the right of withdrawal, provided that the Seller has already received the returned goods or that you provide proof that the goods have already been shipped. The Seller will process the refund using the same payment method used for the initial transaction, unless you explicitly request a different method and the Seller agrees. By way of example, the refund methods may include reimbursement to your credit card or PayPal account, bank transfer to your current account, etc.

8.6 In the event of withdrawal, the only costs you will bear are the initial shipping costs of the order. All other costs will be refunded by the Seller, including return shipping costs, except for any additional costs incurred due to your choice of a more expensive delivery method than the standard delivery offered by the Seller.

8.7 Mundi Wunderkammer also agrees to cover the initial shipping costs of the Products only in cases where the damage is due to transportation or an error in shipment by the Seller. Only in these cases, the Seller will also refund the shipping costs you paid. The Seller will send an express courier to pick up the Product at the address you provided.

8.8 For the return, you must use only the Courier specified by the Seller in the Online Return Form. This way, you will not need to pay the return shipping costs directly, as the Seller will cover them on your behalf. Subsequently, except in the cases outlined in paragraph 8.7 and in cases of defective product returns, the Seller will deduct from your refund a flat amount equal to the shipping and delivery costs initially paid by you or the standard shipping costs applicable to your delivery country. Furthermore, from the moment the purchased products are handed over to the courier designated by the Seller in the online return form, the Seller releases you from any responsibility in case of loss or damage of the products during transportation.

8.9 If the right of withdrawal is exercised, the Seller will process the corresponding refund within 30 days from the date the returned Products are received, using the same payment method chosen by you at the time of the Order.

8.10 If the right of withdrawal is exercised without complying with the above-mentioned conditions (e.g., beyond the 14-day legal period, or without completing the Online Return Form, etc.), the Seller will return the purchased Products to you and charge you for any additional shipping costs.

8.11 The right of withdrawal cannot be applied to personalized products specifically requested by you at the time of placing the Order.

10. Customer Communications

The Customer acknowledges, accepts, and consents that all communications, notifications, certifications, information, statements, and any documentation related to transactions carried out for the purchase of Products will be sent to the email address provided at the time of registration, with the possibility of downloading the information onto a durable medium as provided by the Site.

12. Applicable Law, Dispute Resolution, and Jurisdiction

12.1 These General Terms and Conditions of Sale are governed by Italian law and will be interpreted accordingly, subject to any prevailing mandatory provisions of the country of the Customer's habitual residence. Consequently, the interpretation, execution, and resolution of the General Terms and Conditions of Sale are exclusively subject to Italian law, and any disputes related to or deriving from them shall be settled exclusively by the Italian jurisdiction. In particular, if the Customer qualifies as a Consumer, any disputes shall be resolved by the court of the Customer’s place of residence or domicile under applicable law, or, at the Consumer’s choice in case of legal action, by the Court of Turin. If the Customer acts in the course of their business, trade, craft, or profession, the parties expressly agree that the exclusive jurisdiction shall be the Court of Turin.

13. Important Note

The offer concerns an antique item or piece of furniture, which may, in some cases, present minor defects and/or signs of wear due to age and use, normally visible in the photographs and/or described in the listing text.

If the item or furniture requires restoration, this information will be included in the listing, along with details on whether the restoration can be carried out before shipping at the Customer’s request. In such cases, the costs will be specified and borne by the buyer. These costs may be subject to increases or decreases based on specific agreements between the parties regarding additional or reduced interventions on the item/furniture.

If restorations are not explicitly stated in the listing, any desired restoration shall be at the exclusive care and expense of the buyer.

By completing the purchase and making payment, the buyer acknowledges and accepts these conditions.

14. Modifications and Updates

The Seller reserves the right to modify or amend these General Terms and Conditions of Sale at any time. Therefore, Customers will be required to accept only the version of the General Terms and Conditions of Sale in effect at the time of purchase.

The new General Terms and Conditions of Sale will be effective from the date of publication on the Mundi Wunderkammer website and will apply to purchase orders submitted after that date.
